Smart Living Service Terms of Use

Article 1 (Purpose)

These terms of use (the “Terms”) are to set forth the rights, obligations and responsibilities of the Company and the User and other necessary matters in connection with the use of Smart Living services provided by Irevo Assa Abloy Korea (the “Company”).

Article 2 (Definition)

The terms used herein shall be defined as follows.

  • • "Services" means Smart Living services, including terminal (digital door-lock) services that are available to User.
  • • "User" means a customer using the Services provided by the Company by accessing them hereunder.
  • • "ID" means a combination of letters, numbers and an email address approved by a social network service (SNS) the User joins for his/her identification and use of the Services.
Article 3 (Publication and Amendment)
  • • The Company shall post these Terms on the first page of the Smart Living application to be easily recognizable to the User.
  • • The Company may amend these Terms to the extent not prevented by the relevant laws, including the Act on the Regulation of Terms, and Conditions and the Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc. (the “Information Act”).
  • • If the Company amends these Terms, it shall notify the effective date and reasons for amendment with the current Terms pursuant to Paragraph ① for the period from 30 days before the effective date to the previous date thereof. However, if an amendment of the Term is not favorable to the User, it shall separately give the User a clear notice of such amendment via electronic means, such as consent pop-up on login for a reasonable period.
  • • Notwithstanding that the Company clearly announces or notifies to the User that his/her failure to give consent to an amendment hereof within 30 days after its announcement or notification thereof constitutes his/her consent, if the User fails to express his/her objection, he/she shall be deemed to have consented to the amendment.
  • • If the User does not consent to the amendment hereof, the Company cannot apply it, and the User may terminate these Terms. However, if there is any extraordinary circumstance preventing the application of the existing Terms, the Company may terminate these Terms.
Article 4 (Interpretation)

Matters or interpretation not specified in these Terms shall be governed by the relevant laws or commercial practices.

Article 5 (Use of Services)

A person desiring to be User (the “Applicant”) may use the Services after consenting to these Terms when initializing the service application and completing the identification procedures via SNS.

Article 6 (Obligation to Protect Personal Information)

The Company will endeavor to protect the User’s personal information in compliance with the relevant laws, including the Information Act. The protection and use of personal information shall be subject to the relevant laws and the Company’s privacy policy.

Article 7 (User’s Obligation to Manage ID)
  • • The User shall be responsible for managing his/her ID and shall not allow a third party to use it.
  • • If the User’s ID may leak personal information, be misunderstood as that of the Company or its manager, or is against social norms or public morals, the Company may restrict the use of such ID.
  • • If the User becomes aware that his/her ID has been used by a third party, he/she shall immediately give the Company notice thereof and follow any instructions of the Company.
  • • In Paragraph ③, the Company shall not be liable for any damage incurred by the User for his/her failure to give such notice to the Company or follow its instructions after giving such notice.
Article 8 (Notice to User)
  • • The Company may provide a notice to a User by using email addresses, mobile-phone numbers, etc. registered by the User.
  • • The Company may publicize notice to the entire Users on its Smart Living application or website(https://www.egateman.co.kr) for seven days or longer instead of giving notice under Paragraph ①.
Article 9 (Company’s Obligation)
  • • The Company shall not be engaged in any act prohibited by the relevant laws and these Terms or against public morals, and will do its best to provide the Services continuously and steadily.
  • • The Company shall operate the security system for protection of personal information (including credit information) so that the User can use the Services safely. The Company shall post and observe the privacy policy.
Article 10 (User’s Obligation)
  • • The User shall not do any of the following:
  • • Registration of false information at application or alteration;
  • • Illegal use of other’s information;
  • • Modification of information posted by the Company;
  • • Collection of another User’s personal and account information;
  • • Grant of access to a third party;
  • • Infringement of intellectual property rights, including copyrights of the Company or a third party; and
  • • The User shall observe the relevant laws, these Terms, guidelines and publicized precautions regarding the Services, the Company’s notices, etc. and shall not otherwise obstruct the Company’s business.
Article 11 (Provision of Services)
  • • The Company shall provide the User with Smart Living services.
  • • The Services shall be provided on a 24/7 basis.
  • • The Company may temporarily suspend provision of the Services if there are repair/maintenance works, replacement or failures of IT equipment, including computers, communication shutdowns or other operational causes. In this case, the Company shall notify the User of such suspension via its website or application.
  • • The Company may conduct regular inspection of the Services if necessary for the provision thereof, and inspection hours shall be as posted on the service application.
Article 12 (Change to Services)
  • • The Company may modify or suspend all or any part of the Services to meet its policy or operational needs if there are reasonable causes, including difficulties in efficient provision of the Services due to decreased uses thereof, lower profitability, necessity of switching to next-generation services for technological advancement and amendment of its policies on the provision of the Services.
  • • If there is any change or suspension in contents of the Services, usage or hours, it shall give 30-day prior notice thereof, specifying the details on the Services to be changed or suspended and relevant reasons, dates, etc. on its website or the ‘notice’ section of the application so that the User can fully recognize them.
Article 13 (Provision of Information and Advertising)
  • • The Company may provide the User with various information deemed necessary for the User’s use of the Services by posting on the ‘notice’ section of the application.
  • • The Company may post advertisements on the screen of its Smart Living service application or website in connection with the operation of the Services.
Article 14 (Vesting of Rights)
  • • Copyrights and intellectual property rights to the Services shall be vested in the Company.
  • • The Company holds, or has the ownership or the right to copyrights and intellectual property rights on all trademarks, service marks, logos, etc. relating to designs of services it provides and texts, scripts, graphics, etc. it creates for its services under the laws of Korea and other countries.
  • • The User does not own the Services or hold the copyright on it but is allowed to use it by the Company under these Terms. Therefore, the User may solely use the Services for information acquisition and personal use purposes.
  • • The Company shall grant the User only the right to use its account, ID, contents, etc. under the conditions set by the Company in connection with the Services, and the User shall not dispose of such right by transferring, selling, or providing as collateral such right.
Article 15 (Termination)
  • • The User may cease using the Services at any time by deleting its account or the application.
  • • If the User terminates its agreement with the Company, all data on the User shall be deleted within five days after the termination thereof except to the extent the Company retains such information pursuant to the relevant laws and its privacy policy.
Article 16 (Restriction of Use)
  • • If the User breaches its obligation hereunder or obstructs normal operation of the Services, the Company may gradually restrict its use of the Services in the order of warning, temporary suspension, permanent suspension, etc.
  • • The conditions and details on the restriction of use under this Article shall be determined pursuant to the Company’s policy on the restriction of use.
  • • If the Company restricts the use of the Services or terminates its agreement with the User under this Article, it shall notify the User under Article 8 hereof.
  • • The User may raise an objection to the restriction of use under this Article with the Company under the procedures determined by the Company. If the Company considers such objection justifiable, it shall immediately allow the User to resume using the Services.
Article 17 (Limitation of Liability)
  • • If the Company cannot provide the Services due to a natural disaster or any similar force majeure event, it shall be exempted from the liability for providing the Service.
  • • The Company shall not be liable for a failure to use the Services due to a reason attributable to the User.
  • • The Company shall not be liable for the credibility, accuracy, etc. of information, data, facts published by the User concerning the Service.
  • • The Company shall not be liable for uses of free services unless they are governed by provisions of the relevant laws.
  • • The Company and its officers, employees and agents shall not be liable for any damage below:
    • • Damage caused by the falseness or inaccuracy of information on the User;
    • • If no Company’s gross negligence, personal damage incurred during log-in to or use of the Services regardless of its nature and cause;
    • • If no Company’s gross negligence, damage caused by an illegal access to or an illegal use of a server by a third party; or
    • • If no Company’s gross negligence, damage caused by illegal obstruction or suspension of transmission from or to a server by a third party.
Article 18 (Use Outside Korea)

The Company provides and manages the Services based on servers installed in Korea. If the User desires to use the Services in a region other than Korean territories, the Company does not guarantee the quality or usability of the Services. Accordingly, the User desiring to use the Services in a region other than Korean territories shall decide whether to use it at his/her own judgment and responsibility and be required to observe local laws in using the Service.

Article 19 (Governing Law and Jurisdiction)
  • • Any dispute between the Company and the User shall be governed by the laws of Korea.
  • • A court under the Civil Procedure Act shall have jurisdiction over a dispute between the Company and the User.
